1. Agreement to These Terms

These Terms and Conditions govern your access to and use of Oak Coliseum, including its website, applications, tools, account features, Pokémon inventory management features, recommendation systems, Premium services, and related services.

By accessing or using Oak Coliseum, you agree to these Terms and to the Oak Coliseum Privacy Policy.

If you do not agree to these Terms, you should not access or use Oak Coliseum.

2. About Oak Coliseum

Oak Coliseum is an independent team analysis and recommendation platform designed to help Pokémon GO players evaluate Pokémon they own and identify potential teams for player-versus-player competition.

Oak Coliseum may provide tools that analyze information including:

• Pokémon species and forms
• Combat Power (CP)
• Individual Values (IVs)
• Pokémon levels
• Fast and Charged Moves
• League eligibility
• Competitive rankings
• Current or historical meta information
• Team composition
• Type relationships
• Battle roles
• Other competitive characteristics

Oak Coliseum provides recommendations and analytical information. It does not guarantee any particular battle result, ranking, tournament result, rating improvement, or competitive outcome.

3. Eligibility

You may use Oak Coliseum only if you are legally permitted to enter into these Terms or have any permission or consent required by the laws that apply to you.

You are responsible for providing accurate account information and for complying with applicable age requirements, parental consent requirements, and other legal obligations in your location.

4. Accounts

Certain Oak Coliseum features may require an account.

When creating or maintaining an account, you agree to:

• Provide accurate and current information
• Keep your account information reasonably current
• Maintain the confidentiality of your login credentials
• Use a secure password
• Notify Oak Coliseum of suspected unauthorized account access
• Accept responsibility for activity occurring through your account

You may not impersonate another person, create accounts for fraudulent purposes, or access another person's account without authorization.

5. Pokémon Inventory Information

Oak Coliseum may allow you to manually enter, upload, import, edit, organize, and store information about Pokémon you own.

You are responsible for the accuracy of the information you provide. Recommendation quality may be affected by inaccurate, incomplete, or outdated inventory information.

Oak Coliseum may use your submitted inventory information to:

• Determine league eligibility
• Evaluate individual Pokémon
• Compare available Pokémon
• Generate candidate team combinations
• Generate personalized team recommendations
• Calculate recommendation scores
• Identify strengths, weaknesses, and team characteristics
• Save teams or recommendations associated with your account

6. Recommendations and Analysis

Oak Coliseum recommendations are generated using analytical methods, competitive data, rules, scoring systems, algorithms, simulations, or combinations of these approaches.

Recommendations may change when:

• Game mechanics change
• Moves are added, removed, or rebalanced
• Pokémon statistics change
• New Pokémon or forms become available
• League or cup eligibility changes
• The competitive meta changes
• Underlying rankings or data sources change
• Oak Coliseum improves or modifies its recommendation methods

A recommendation displayed at one time may differ from a recommendation generated later using the same inventory.

Users should exercise their own judgment when deciding whether to spend Stardust, Candy, Candy XL, Elite TMs, or other game resources. Oak Coliseum is not responsible for game resources spent based on a recommendation.

7. Third-Party Data and Resources

Oak Coliseum may use, reference, process, display, or derive analysis from publicly available or appropriately licensed third-party data and resources.

These may include competitive rankings, game information, move data, type information, images, sprites, statistics, or other resources.

Third-party data may contain errors, become outdated, change without notice, or become temporarily unavailable.

Oak Coliseum does not guarantee the accuracy, completeness, or continued availability of third-party data.

8. Premium Services

Oak Coliseum may offer free and paid account levels.

Premium features may include benefits such as:

• Higher Pokémon inventory limits
• Additional stored teams
• Advanced recommendations
• Expanded league or cup support
• Additional analysis features
• Priority access to new tools or features
• Other benefits described on the Premium page

Premium features, pricing, inventory limits, and benefits may change over time.

Billing and Renewals

If a Premium subscription automatically renews, the renewal terms, billing frequency, price, and cancellation process will be clearly disclosed before purchase.

Users are responsible for canceling subscriptions according to the cancellation instructions provided with the subscription.

Refunds

Refund eligibility will be governed by the refund policy displayed at the time of purchase and by applicable law.

Premium subscriptions are purchased through Stripe. The price, billing frequency, renewal terms, and cancellation options are shown before purchase and remain available through the account billing portal.

9. Acceptable Use

You agree not to misuse Oak Coliseum.

You may not:

• Attempt to gain unauthorized access to another user's account, inventory, data, or credentials
• Attempt to bypass account limitations, subscription restrictions, or security controls
• Use automated systems to overload, disrupt, or impair the service
• Introduce malware, malicious code, or harmful software
• Attempt to interfere with servers, databases, networks, or application infrastructure
• Scrape, harvest, or collect personal information about other users without authorization
• Use Oak Coliseum for fraud, impersonation, harassment, or unlawful activity
• Attempt to reverse engineer protected portions of Oak Coliseum except where applicable law expressly permits such activity
• Copy, reproduce, sell, sublicense, or commercially exploit Oak Coliseum's original software, recommendation systems, design, branding, or original content without authorization
• Use Oak Coliseum in a way that violates applicable law or the rights of another person or organization

10. User-Provided Content

You retain ownership of original content and information you submit to Oak Coliseum, subject to any rights held by third parties in the underlying material.

By submitting information to Oak Coliseum, you grant Oak Coliseum the limited rights necessary to store, process, analyze, display, and transmit that information for the purpose of operating and improving the service.

This permission ends when the information is deleted from Oak Coliseum's active systems, except where continued retention is permitted or required for backups, security, legal compliance, fraud prevention, or other legitimate purposes.

11. Oak Coliseum Intellectual Property

Oak Coliseum retains rights in its original intellectual property, including, where applicable:

• The Oak Coliseum name and original branding
• Original website design and user interface elements
• Original software code
• Original recommendation methodologies
• Original scoring systems and analysis models
• Original written content
• Original graphics and visual materials
• Original databases or data arrangements

These Terms do not transfer ownership of Oak Coliseum's original intellectual property to users.

12. Third-Party Intellectual Property

Pokémon and Pokémon GO are trademarks and copyrighted materials of their respective owners. Oak Coliseum uses Pokémon-related names and gameplay data to identify and analyze Pokémon GO PvP content. Oak Coliseum is an independent fan-made tool and is not affiliated with, endorsed by, or sponsored by The Pokémon Company, Nintendo, Niantic, or their affiliates.

13. Service Availability

Oak Coliseum will attempt to provide a reliable service, but uninterrupted access cannot be guaranteed.

The service may be unavailable because of:

• Maintenance
• Software updates
• Server or hosting failures
• Database issues
• Internet or network interruptions
• Security incidents
• Third-party service failures
• Events outside Oak Coliseum's reasonable control

Oak Coliseum may modify, suspend, replace, or discontinue features or portions of the service.

14. Changes to the Service

Oak Coliseum is expected to evolve over time.

I may add, remove, modify, test, or discontinue features. Recommendation methods, account limits, supported formats, Premium features, and other aspects of the service may change.

Where reasonably appropriate, significant changes affecting paid services will be communicated to affected users.

15. Suspension and Termination

Oak Coliseum may restrict, suspend, or terminate access to an account when reasonably necessary to:

• Respond to a violation of these Terms
• Protect users or the service
• Investigate suspected fraud or abuse
• Comply with legal obligations
• Respond to security threats
• Prevent unauthorized access
• Protect Oak Coliseum's rights or infrastructure

Users may stop using Oak Coliseum at any time and may request account deletion according to the Privacy Policy and available account controls.

16. Disclaimers

To the fullest extent permitted by applicable law, Oak Coliseum is provided on an "as is" and "as available" basis.

Oak Coliseum does not guarantee:

• That the service will always be available
• That all data will always be accurate or complete
• That recommendations will produce wins or rating gains
• That a recommended team will remain optimal after game updates
• That third-party data will remain available
• That all errors or defects will be corrected immediately

Competitive recommendations are analytical opinions produced from available information and the methods used by Oak Coliseum at the time the recommendation is generated.

17. Limitation of Liability

To the fullest extent permitted by applicable law, Oak Coliseum and its owners, operators, employees, contractors, service providers, and affiliates will not be liable for indirect, incidental, special, punitive, exemplary, or consequential damages arising from or relating to the use of, or inability to use, Oak Coliseum.

This includes, where permitted by law, losses related to:

• Loss of data
• Loss of access
• Service interruption
• Reliance on recommendations
• Use of in-game resources
• Competitive losses
• Third-party services

Nothing in these Terms excludes liability that cannot legally be excluded or limited.

18. Indemnification

To the extent permitted by applicable law, you agree to defend, indemnify, and hold harmless Oak Coliseum and its owners, operators, employees, contractors, and affiliates from claims, liabilities, damages, losses, and reasonable expenses arising from:

• Your misuse of Oak Coliseum
• Your violation of these Terms
• Your violation of applicable law
• Your infringement of another party's rights

19. Governing Law

These Terms are governed by the laws of the State of Minnesota and applicable federal laws of the United States, without regard to conflict-of-law principles.

Unless applicable law requires otherwise, disputes relating to these Terms or Oak Coliseum will be brought in the appropriate state or federal courts located in Minnesota.

20. Changes to These Terms

Oak Coliseum may update these Terms as the service evolves or when changes are required because of new features, business practices, service providers, or legal requirements.

Updated Terms will display a revised "Last Updated" date.

Where appropriate, significant changes may also be communicated through the website, account notifications, or email.

Continued use of Oak Coliseum after updated Terms become effective constitutes acceptance of the revised Terms, to the extent permitted by applicable law.

21. Severability

If any provision of these Terms is found to be invalid, unenforceable, or unlawful, the remaining provisions will continue in effect to the fullest extent permitted by law.

22. Entire Agreement

These Terms, together with the Privacy Policy and any additional terms presented for specific services or purchases, constitute the agreement between you and Oak Coliseum regarding use of the service.
